Please take the following steps to be in compliance with NYS requirements for reopening.


1. Read the NY Guidance:

2. Fill out the NYS Safety Plan Template and post it in your place of business and on your website: NYS BUSINESS REOPENING PLAN


3. Read the detailed guidance and affirm you business on the NYS website:


  • At this time, if you have affirmed your business for PHASE II, you are not required to re-affirm for indoor dining. If this changes, we will update this page and notify you via email.


Allowable Activities:

PHASE 3: Indoor dining, takeout, delivery and outdoor seating




Indoor capacity must stay at 50% Occupancy as identified on your Certificate of Occupancy for customers dining indoors, using the restroom, picking up orders, and paying.

Tables must be placed six feet apart in all directions.

Parties seated at the same table are limited to 10 and can be from different households.

Outdoor seating must be six feet apart.


Additional Information

Face Masks: Customers must wear face covering until they are seated and when picking up carry-out and paying at the counter unless they are under the age of two or cannot wear them for medical reason (you can’t ask for documentation). Servers and staff must wear masks when coming within six feet of customers. Employers are responsible for providing appropriate masks for staff. See OSHA guidelines here.

Menus: Multi-use menus are acceptable but must be disinfected after every use.

Foot Traffic: Reduce bi-directional foot traffic in any lines for customers waiting to order, pick up food, be seated, or use the restroom, as well as at pick-up and payment locations. Use signage, tape or any other equally effective means to communicate foot traffic patterns.

Silverware: Use pre-packaged or pre-rolled silverware. Gloves must be worn when pre-rolling.

Condiments: Provide directly to customers in single-use disposable containers or reusable containers that are regularly cleaned and disinfected, ideally between each party’s use.

Employee Health Screenings: Health screenings of employees must be done daily and record kept. See a sample Health Screening sign and log here. Temperature checks are not required.

Cleaning Log: Businesses are required to keep a log of cleaning. Here is a SAMPLE CLEANING LOG. Follow CDC Interim Guidance for Restaurants and Bars.
